1. Relationship​​

• A. Client is solely responsible for creating and implementing his/her own physical, mental, and emotional well-being, decisions, choices, actions, and results arising out of or resulting from the relationship and the calls and interactions with Subtle Fields. As such, the Client agrees that Subtle Fields is not and will not be liable or responsible for any actions or inaction, or for any direct or indirect result of any services provided by Subtle Fields. Client understands this program is not therapy and does not substitute for therapy if needed, and does not prevent, cure, or treat any mental disorder or medical disease.

• B. Client further acknowledges that he/she may terminate or discontinue the relationship at any time.

• C. Client acknowledges that this program is a comprehensive process that may involve different areas of his or her life, including work, finances, health, relationships, education, and recreation. The Client agrees that deciding how to handle these issues, incorporate principles into those areas, and implementing choices is exclusively the Client’s responsibility.

• D. Client acknowledges that this program does not involve the diagnosis or treatment of mental disorders and that it is not to be used as a substitute for counseling, psychotherapy, psychoanalysis, mental health care, substance abuse treatment, or other professional advice by legal, medical, or other qualified professionals and that it is the Client’s exclusive responsibility to seek such independent professional guidance as needed. If Client is currently under the care of a mental health professional, it is recommended that the Client promptly inform the mental health care provider of the nature and extent of the guidance relationship agreed upon by the Client and Subtle Fields.

• E. The Client understands that in order to enhance the outcome, the Client agrees to communicate honestly, be open to feedback and assistance, and to create the time and energy to participate fully in the program.

 

2. Confidentiality​

• A. Client agrees to not share or disperse any content within this portal and understands that this content is owned by Subtle Fields. This means that you may not share your login credentials with another party, nor may you distribute or sell any of our material.

• B. Client agrees that they will not, at any time during this agreement or hereafter, make comments, whether oral or in writing, that attempt to defame, slander, or injure Subtle Fields, its owners, officers, directors, managers, members, agents, employees, contractors, representatives, employees, products and services, or professional or personal reputation of any of the foregoing. **This does not mean you can't leave reviews or testimonials - this means you can't spread false accusations/claims, bully, slander, or abuse. ​

3. Limited Liability​

• A. Except as expressly provided in this Agreement, Subtle Fields makes no guarantees, representations, or warranties of any kind or nature, express or implied with respect to the services negotiated, agreed upon, and rendered. This is because no one can truly heal you but you. In no event shall Subtle Fields be liable to the Client for any indirect, consequential, or special damages. Notwithstanding any damages that the Client may incur, Subtle Fields’s entire liability under this Agreement, and the Client’s exclusive remedy, shall be limited to the amount actually paid by the Client to Subtle Fields under this Agreement for all coaching services rendered through and including the termination date.​​

• B. If the Client chooses to practice with or receive coaching and healing from other students in this program, they understand that this is the Client's decision at their own discernment, and agree to not hold Subtle Fields or its owners, officers, directors, managers, members, agents, employees, contractors, representatives or employees responsible for anything that happens before, during, or as a result of these sessions.

4. Refunds

Due to the nature of the program, there is a strict no-refund policy for all products and services offered within. By accepting this agreement, you are taking ownership of your decision to enroll in this program and therefore agree to not request a refund or file a dispute or chargeback. If you breach this agreement and file a dispute or chargeback, you are responsible for the bank and processing fees incurred by Subtle Fields and will be invoiced these fees via your email on file. By accepting this agreement, you agree to pay these fees by the invoice due date.

Attorneys' Fees & Legal Expenses

If any proceeding or action shall be brought to recover any amount under this Agreement, or for or on account of any breach of, or to enforce or interpret any of the terms, covenants, or conditions of this Agreement, the prevailing party shall be entitled to recover from the other party, as part of the prevailing party's costs, reasonable attorneys' fees, the amount of which shall be fixed by the court, and shall be made a part of any award or judgment rendered.

We reserve the right to terminate your account and program access without a refund or providing communication or notice if you violate any terms within this agreement.
